Welcome to materfocus.com (the "Site"), operated by MaterFocus LLC ("MaterFocus," "we," "us," or "our"). These Terms & Conditions ("Terms") govern your access to and use of the Site and any commissioned products or services purchased through it. By using the Site or requesting a commission, you agree to these Terms.

If you do not agree with these Terms, please do not use the Site.

1. Our Services

MaterFocus offers custom, made-to-order commissioned products, and may also offer certain products for sale in person. Commission requests are submitted through our online quote request form. Availability, pricing, and turnaround time for commissions are provided on a case-by-case basis after reviewing your request.

2. The Commission Process

1. Request a Quote. You submit your commission idea, reference photos, and contact details through our quote request form.

2. Quote Review. We review your request and, if we are able to accommodate it, provide you with a quote by email, including price and estimated timeline.

3. Approval & Payment. If you approve the quote, we will send you a payment link by email through a third-party payment processor. Work on your commission begins once payment is received, unless otherwise agreed in writing.

4. Completion & Delivery. We will complete your commission according to the agreed description and timeline, and arrange delivery or pickup as agreed.

Turnaround times are estimates and may vary based on order volume, materials, or the complexity of your request. We will communicate any significant delays as soon as we're aware of them.

3. Pricing and Payment

• All prices are quoted in U.S. Dollars unless otherwise stated.

• Payment is due as specified in your quote (which may require full or partial payment upfront).

• Payments are processed by a third-party payment processor; MaterFocus does not store your full payment card details.

• Commissions are custom-made based on your specifications. Because of this, all commission sales are generally final once work has begun, except as described in Section 4 below.

4. Cancellations, Changes & Refunds

• If you wish to cancel or modify your commission, contact us as soon as possible at support@materfocus.com.

• Cancellations requested before work has begun may be eligible for a full or partial refund, at our discretion.

• Cancellations requested after work has begun may only be eligible for a partial refund, reflecting materials and labor already committed, at our discretion.

• If a completed commission arrives damaged, defective, or does not match the agreed description, please contact us within 7 days of delivery with photos of the issue so we can make it right (repair, replacement, or refund, at our discretion).

• Custom commissions are not eligible for return simply due to change of mind, given their personalized nature.

5. Your Submissions (Photos & Commission Details)

When you submit reference photos or commission ideas, you confirm that:

• You own the rights to any images you submit, or have permission to share them with us for the purpose of creating your commission; and

• Your submission does not infringe on any third party's intellectual property, privacy, or other rights.

We use your submitted materials solely for the purpose of creating and fulfilling your commission, as described in our Privacy Policy.

6. Intellectual Property

Unless otherwise agreed in writing, MaterFocus retains the right to photograph, display, and promote completed commissions (e.g., on our website, social media, or portfolio) for marketing purposes, unless you request otherwise at the time of your order. Your personal information, photos submitted for reference, and identifying details will not be shared publicly without your consent.

All content on the Site — including text, graphics, logos, and images (excluding customer-submitted materials) — is the property of MaterFocus LLC and may not be used without our permission.

7. In-Person Sales

Products purchased in person are subject to the same general quality and satisfaction principles described above, though the specific process for exchanges or issues will be discussed directly at the time of purchase.

8. Limitation of Liability

To the fullest extent permitted by law, MaterFocus LLC shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the Site or purchase of a commissioned product, including but not limited to delays, shipping issues, or dissatisfaction with subjective aspects of a custom design that was created in line with the agreed description.

Our total liability for any claim relating to a commission is limited to the amount you paid for that commission.

9. Disclaimer

The Site and its content are provided "as is" without warranties of any kind, express or implied. We do not guarantee that the Site will be uninterrupted, error-free, or completely secure.

10. Third-Party Services

Our commission process relies on third-party services, including Google Forms (for quote requests) and a third-party payment processor. Your use of those services is also subject to their own terms and privacy policies.

11. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict of law principles, unless otherwise required by applicable consumer protection law in your jurisdiction.
